These Terms and Conditions (“Terms”) govern the use of the website www.usedpartsabc.com (the “Website”) and all services provided by and from an integral part of any agreements concluded via the Website. By using the Website, placing orders, or otherwise engaging with the Company, the user (“User”) agrees to these Terms.

1. Introduction & Definitions

1.1 Company: responsible for the management and operation of the Website.

1.2 User: Any individual or legal entity visiting the Website, browsing products, or purchasing goods or services.

1.3 Product: Used or new vehicle parts, accessories, or other items offered for sale on the Website.

1.4 Advertisement: The display of Products on the Website, sourced from original sellers, translated, and published by the Company.

1.5 Original Seller: The entity or individual who owns or sells the Product. The Company acts solely as an intermediary between the Original Seller and the User.

1.6 Consent: By using the Website, placing an order, or providing personal data, the User agrees to these Terms and the processing of personal data in accordance with the Privacy Policy.

2. Service Agreement & Order Process

2.1 Formation of Agreement:
An agreement between the Company and the User is concluded when the User:

  • Selects a Product and adds it to the cart.
  • Provides the delivery address and selects a payment method.
  • Reviews and accepts these Terms.
  • Clicks the “Order” button.

2.2 Order Confirmation:
The Company will send an order confirmation email, including invoice and payment details. The User must ensure all provided information is accurate, including name, address, and payment details.

2.3 Right of Withdrawal:
Private individuals within the EU may withdraw from the agreement within 14 days of the first delivery attempt. Business users or entities outside the EU are not entitled to this withdrawal right.

3. Prices, Payment, and Invoicing

3.1 Currency: All prices are listed in euros (€).

3.2 Price Composition:

  • Product Price: The price set by the Original Seller.
  • Company Fee: 10–150% of the Product Price to cover services, including order processing, website administration, and delivery coordination.

3.3 Payment Methods:

  • Bank transfer (manual or via Paysera).
  • Credit/debit card via Paysera.

3.4 Payment Timing:
Orders are only processed and delivery initiated after full payment is received.

3.5 Invoices:
Invoices are sent electronically to the email address provided by the User. Manual payment requires precise copying of bank account details to avoid delays.

3.6 Price Changes:
If unforeseen factors affect Product pricing after order placement, the Company or User may terminate the agreement within 3 days of notice, without indemnification for losses.

4. Delivery & Shipping

4.1 Delivery Methods:

  • Delivery to User-specified address.
  • Pickup from Company warehouse (details in FAQ).

4.2 Delivery Timeframe:

  • EU deliveries: 3–8 working days.
  • Non-EU deliveries: up to 30 working days (depending on location).
  • Delays due to force majeure or User actions (wrong address, customs issues) are exempt from Company liability.

4.3 Shipping Terms for Non-EU (DAP – Delivered at Place):

  • Buyer is responsible for import duties, taxes, and customs clearance.
  • Refusal to pay these fees does not allow order cancellation.
  • Returned shipments due to unpaid duties or taxes will not be refunded.

4.4 Delivery Confirmation:
The User (or authorized representative) must inspect the package and sign a delivery document. Any visible damage or discrepancies must be documented immediately. Ownership and risk transfer to the User upon delivery confirmation.

4.5 Failed Delivery / Customer Error:
If delivery fails due to incorrect information, unreachable contact, or customs issues, the User bears return and reshipment costs, totaling up to 3× the original shipping fee.

4.6 Warehouse Pickup:
Products held at the Company warehouse will be stored for a maximum of 30 days. Failure to pick up items within this period results in the order being marked complete and the User forfeiting any claims.

5. Returns, Refunds, and Warranty

5.1 Return Conditions:

Product must be in original packaging, unused, and undamaged (unless defective).
Proof of purchase and warranty card (if applicable) must be included.
Returns must be made promptly, within the legally required timeframe.
5.2 Responsibility for Return Shipping:

If the return is due to Company error, the Company covers shipping.
If the User changes their mind or orders incorrectly, the User bears shipping costs.
5.3 Replacement and Refund:

Primary remedy: Product replacement.
Refund issued only if replacement is not feasible.
5.4 Installation / Additional Costs:
All costs related to installation, seals, fluids, labor, and any associated work are the responsibility of the Buyer. The Company covers only the replacement or refund of the Product itself, if eligible under these Regulations or applicable law.

5.5 Defective Products:
Defects must be reported directly to the Original Seller. The Company will assist with communications and logistics for return or replacement.

6. User Rights and Personal Data

6.1 Accuracy of Information:
Users are responsible for providing and maintaining accurate personal data.

6.2 Data Processing & Privacy:
Personal data is processed according to the Privacy Policy for:

  • Order processing, shipping, delivery tracking
  • Returns, refunds, and claims
  • Customer support communications (emails, chat, calls)
  • Marketing and newsletter preferences (opt-in/opt-out available at any time)

6.3 Access and Control:
Users can access, correct, or request deletion of their personal data, and withdraw consent for marketing communications.

7. Company Rights and Obligations

7.1 Website Operation:
The Company may suspend or modify the Website, its services, or Terms at any time without prior notice.

7.2 Order Management:

  • Orders may be canceled if payment is not received within 3 business days.
  • Sale may be declined if information is inaccurate or misleading.

7.3 Delivery Obligations:
The Company ensures Product delivery as agreed but is not liable for delays due to force majeure or User actions.

7.4 Intermediary Role:
The Company only facilitates transactions between the User and Original Seller; it does not manufacture, own, or directly sell Products.

8. Product Quality Guarantee

8.1 Product Information:

Product descriptions and images provide general guidance.
Actual Product appearance may vary due to technical or display differences.
8.2 Liability Limitations:
The Company is not liable for deterioration caused by misuse, incorrect storage, installation, or natural events.

8.3 Pre-Owned Products:
Users acknowledge that Products may be used and accept that the Company’s responsibility is limited to facilitating order, delivery, and coordination with Original Seller.

9. Liability

9.1 The User is responsible for all actions on the Website, including accuracy of personal data and login credentials.

9.2 The Company is not liable for:

  • Linked third-party websites
  • Partner services beyond delivery or order facilitation
  • Indirect, incidental, or consequential losses

9.3 Liability is limited to direct losses only, within legal limits.

10. Information Exchange

10.1 Company Communication: Notifications sent to the email and phone number provided by the User.

10.2 User Communication: All inquiries should be sent via contact methods on the Website (email, chat, phone).

11. Final Provisions

11.1 These Terms are governed by the laws of the Republic of Estonia.

11.2 Disputes should first be resolved via negotiation. If unsuccessful, disputes will be settled according to Estonian law.

11.3 All information provided on the Website (including Terms, Product info, order confirmations) is considered provided in writing.

11.4 These Terms do not limit statutory rights of Users.
